1. Consent is required before you send
You may only message a recipient who has given you prior express consent to receive messages at that number, for the kind of message you are sending. Consent must come from the recipient, must be recorded, and must not be bought, rented, scraped, or inherited from another sender or another brand.
You must be able to show, per number:
- when and how consent was captured (web form, checkout, keyword opt-in, signed agreement);
- exactly what the recipient was told they were signing up for;
- that marketing consent was collected separately from transactional consent.
OMNI NOVAS Tech may ask for this evidence at any time. Accounts that cannot produce it may be suspended while the traffic is reviewed.
2. Identify yourself in every message
The first message in any conversation must identify the business sending it. Do not send messages whose sender ID, content, or links imply they come from a business, bank, government body, or person other than you. Sender IDs registered on the platform must belong to the account that uses them.
3. Opt-out must always work
Every recipient may stop your messages at any time, at no cost, without talking to a human.
Opt-out keywords are yours to configure, and configuring them is mandatory:
- Register the standard opt-out words — at minimum
STOP, STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT — for every contact group you send to, under Contacts → Contact groups → Opt-out keywords, plus the keyword itself under Keywords. OMNI SMS does not assume a default list on your behalf.
- Register
HELP and INFO the same way, with a reply that gives your business name and a way to reach your support.
- An opt-out applies to the number that sent it, immediately, and must be honoured across every campaign, list, and device on your account.
- Send one confirmation of the opt-out, then nothing further. Do not ask the recipient to reconsider, and do not require them to opt out again per list.
- Do not re-add an opted-out number without fresh consent captured after the opt-out.
- An opt-out that reaches you outside the platform — by email, by phone, in person — must be added to your blacklist manually, under Security → Blacklist.
When a recipient sends a registered opt-out keyword, the platform unsubscribes them from the contact group and adds the number to your account blacklist. Sends to a blacklisted number are rejected, including inside bulk and campaign sends. Removing a number from the blacklist to keep messaging it is a violation of this policy.
4. Prohibited content and traffic
You may not use OMNI SMS to send:
- unsolicited bulk messaging of any kind;
- phishing, credential harvesting, spoofed sender identities, or any message designed to deceive the recipient about who is contacting them;
- fraud, pyramid or "get rich quick" schemes, fake prizes, or deceptive lending, debt-relief and credit-repair offers;
- malware, or links to sites hosting malware or attempting drive-by installs;
- threats, harassment, hate speech, or content that promotes violence against a person or group;
- sexually explicit material, or content promoting the sexual exploitation of any person;
- content that is illegal for the sender or the recipient in either party's jurisdiction — including regulated categories such as cannabis, prescription medication, firearms, and gambling where those are restricted;
- traffic engineered to evade carrier filtering: URL shorteners that mask the destination, rotating sender IDs or numbers for the same campaign ("snowshoeing"), deliberate misspelling to defeat content filters, or splitting one campaign across many accounts.
5. Timing, volume and platform integrity
- Send promotional messages inside reasonable local hours for the recipient, and respect any stricter quiet-hours rule that applies where they are. Time-sensitive transactional messages — one-time passcodes, delivery alerts, fraud warnings — are exempt.
- Stay inside the throughput and volume of your subscription package. Do not create additional accounts to work around a limit, and do not resell your account's API access.
- Do not probe, load-test, or attempt to gain unauthorised access to the platform, its API, its gateways, or another customer's data.
- Keep your API token secret. You are responsible for all traffic sent with it. Rotate it from Developer → API documentation if you believe it has been exposed.
6. Your legal obligations
You are the sender of record for your traffic. You are responsible for complying with the messaging law that applies to you and to your recipients — including, where applicable, the US TCPA and CTIA messaging principles, Canada's CASL, the UK PECR, and the EU GDPR and ePrivacy rules — as well as the rules of the carriers and messaging providers that carry your traffic. Where you send WhatsApp traffic, the WhatsApp Business Messaging Policy applies in addition to this policy.
OMNI NOVAS Tech provides the platform; it does not review your recipient lists or your message content in advance, and it is not your compliance advisor. If you are unsure whether a campaign is lawful, get advice before you send it.
7. Enforcement
We investigate complaints, carrier reports, and unusual traffic patterns. Depending on severity we may throttle the account, block a sender ID or destination range, suspend sending, or terminate the subscription. Serious cases — fraud, phishing, illegal content — may be suspended immediately and without notice, and may be reported to the relevant carrier or authority. Termination for a policy violation is not eligible for a refund under our
Refund Policy.
8. Report abuse
To report a message sent through OMNI SMS that appears to violate this policy, contact us with the sender ID or originating number, the recipient number, the message text, and the date and time received.
